CARELS.CA INTERNET WEBSITE USER/VISITOR AGREEMENT

TERMS AND CONDITIONS

The user(s)/visitor(s) entry, use and viewing of CARELS.CA's internet website automatically indicates the user(s)/visitor(s) acceptance of CARELS.CA's user/visitor agreement and policies. 

If the user(s)/visitor(s) to CARELS.CA's website does not agree with 100% of CARELS.CA's user/visitor agreement and policies, the user(s)/visitor(s) should immediately exit CARELS.CA's internet website and not return.

CARELS.CA's internet website is available to our customer(s)/advertiser(s) for a legal and proper moral use only.  Any listing deemed in CARELS.CA's opinion, to violate our high code of ethics, will be removed immediately from CARELS.CA's internet website.

The user(s)/visitor(s) agrees to indemnify and save CARELS.CA and or CARELS.CA Independent Dealer(s) harmless against any and all claims, action, obligation, liabilities, costs, expenses and fees arising from use or visitation on CARELS.CA's internet website, including but not limited to, any error(s), omission(s), misrepresentation(s) or inaccuracy(s) in the content of the advertised listings on CARELS.CA's internet website.

Each posted listing in the CARELS.CA advertising system will contain only one (1) real estate property for sale or for rent/lease.

CARELS.CA and CARELS.CA Independent Dealers are in the business of advertising on behalf of our customer(s)/advertiser(s), real estate whether for sale or for rent/lease.  On behalf of our customer(s)/advertiser(s), CARELS.CA and CARELS.CA Independent Dealer(s) gather the necessary information concerning the customer's real estate, in order to advertise the real estate via various methods.  CARELS.CA and CARELS.CA Independent Dealer(s) prepare, then present the gathered information, from information supplied by the real estate owner or the real estate owner's representative.

The accuracy of the information on CARELS.CA's internet website and other mediums produced by CARELS.CA and or CARELS.CA Independent Dealer(s) is not guaranteed to be correct and no warranty is expressed, written or implied.  CARELS.CA and CARELS.CA Independent Dealer(s) cannot control the accuracy of the information supplied by the real estate owner or the real estate owner's representative and thus shall not be held liable for any error(s), omission(s), misrepresentation(s) or inaccuracy(s) that may occur.  If such a liability should be established, the dollar amount to provide settlement shall never exceed the amount paid by the customer/advertiser for that portion of the advertisement. 

Any error(s), omission(s), misrepresentation(s) or inaccuracy(s) is the responsibility of the customer(s)/advertiser(s).  It is the customer(s)/advertiser(s) responsibility to review their posted listing on CARELS.CA's internet website and report all items that require correction to CARELS.CA or CARELS.CA Independent Dealer.  Upon written notice from the customer(s)/advertiser(s), CARELS.CA or CARELS.CA Independent Dealer will immediately correct the designated error(s), omission(s), misrepresentation(s) or inaccuracy(s). 

CARELS.CA's internet website, user(s), visitor(s), real estate purchaser(s) and all other interested parties should with due diligence, evaluate, investigate and satisfy themselves with the correctness and validity of the provided information.  The perspective purchaser(s) should consult a lawyer prior to signing any document(s).

GENERAL

·         CARELS.CA and CARELS.CA Independent Dealers are not real estate brokers or real estate broker's agents.

·         CARELS.CA and CARELS.CA Independent Dealers are not affiliated in any way with real estate brokers or real estate broker's agents.

·         At the customer(s)/advertiser(s) request CARELS.CA and or CARELS.CA Independent Dealers may provide many services on behalf of the customer(s)/advertiser(s) in an effort to assist with the sale or rental/lease of real estate belonging to customer(s)/advertiser(s).

·         CARELS.CA and CARELS.CA Independent Dealers will NOT broker the sale or rent/lease of real estate.

·         Any negotiated agreement may be made between the seller and the buyer with the assistance and guidance of their respective lawyers.

·         CARELS.CA and or CARELS.CA Independent Dealers are NOT at any time acting as agents for either sellers, buyers or renters of real estate.

·         CARELS.CA and CARELS.CA Independent Dealer(s) agreement with its customer(s)/advertiser(s) is that of a non-commission arrangement.

·         CARELS.CA and or CARELS.CA Independent Dealer(s) charges are based upon services ordered by the customer(s)/advertiser(s) and provided by CARELS.CA and or CARELS.CA Independent Dealer(s).

·         CARELS.CA and or CARELS.CA Independent Dealers are not responsible or liable in any way or manner for the non sale or non rental/lease of the real estate belonging to the customer(s)/advertiser(s), during or after the period of time the real estate was listed with CARELS.CA and posted on CARELS.CA's  internet website.

COPYRIGHT

·         CARELS.CA's internet website content, database, etc. are protected by copyright laws and are owned exclusively by CARELS.CA. 

·         CARELS.CA strictly forbids the commercial or unlawful use of information contained on CARELS.CA posted listings.

·         CARELS.CA allows the internet website user(s)/visitor(s) to access and view listings of interest.  The user(s)/visitor(s) may print a copy of any listing, providing the copy is not altered in any way and is intended for private use only.

·         CARELS.CA prohibits user(s)/visitor(s) that enter the CARELS.CA internet website, from gathering information about CARELS.CA, CARELS.CA Independent Dealer(s), customer(s), advertiser(s), user(s), visitor(s) and associate(s), without first obtaining written consent from the person(s) or company(s) in question.

TRADEMARKS

CARELS.CA and CARELS.CA's logos are trademark possessions of CARELS.CA Inc.  Any use of CARELS.CA and CARELS.CA's logos is strictly prohibited unless specifically authorized in writing by CARELS.CA Inc. authorized personnel.

·         From time to time CARELS.CA's internet website may contain links to other internet websites.

·         These links are provided solely as a convenience for our user(s)/visitor(s).  CARELS.CA provides no warranty, expressed, written or implied, as to the content, policies, terms and conditions, of the linked or third party internet website(s).

·         When a user(s)/visitor(s) to CARELS.CA's internet website clicks on a link, the user(s)/visitor(s) immediately exits CARELS.CA's internet website and enters the internet website of the link.

REFUNDS

CARELS.CA and or CARELS.CA Independent Dealer(s) do not issue refunds to our customer(s)/advertiser(s) after our completion of

·         In home visit.

·         Gathering necessary information.

·         Collection of full payment for our services.

·         Creation and posting of listing on CARELS.CA's internet website.

·         Installation of lawn sign (at customer's request).

The listing will remain in effect for up to 6 months at no extra cost.  If the listing is terminated within the 6 month period, for whatever reason, NO refund will be issued.
